In this memo, I assessed the merits of four defenses raised against our client and properly documented the reasons why each defense could be successful. The first portion of this project was the memo to the managing partner breaking down the elements of the crimes each defendant was charged with in order to see which defendant we should take on as a client for the best chances of a victory. I analyzed the facts of each charge for each defendant thoroughly so I could provide an opinion as to the outcome of each case. I also provided a clear explanation as to the differences between the crimes of conspiracy, accessory, and accomplice after the fact. The second portion of this was my trial brief focusing on the issue of double jeopardy in a crime that could be punishable at the federal or state level. By breaking down the federal and state elements of kidnapping and conducting the proper research, I was able to conclude that it is not double jeopardy because both jurisdictions are sovereign and would not be considered the same crime under the fifth amendment. I also properly included a section heading with proper case captions per each section of the introduction, statement of facts, analysis, and conclusion. In doing this, I successfully completed this trial brief and found relief for the issues stated therein. By preparing my motion to dismiss, I identified the applicable rules of criminal procedure that permitted me to create this motion and the basis upon which I did. I ensured that I included the correct citations and statutes as this is a document that will be referred to in court, and any mistakes can cause it to be rejected hindering our entire defense. For the memorandum of law, I thoroughly analyzed the relevant facts that supported my motion in the introduction section. In the analysis section, I included exactly how my state defines the defenses of infancy, intoxication, and duress. I also included references to the applicable Tennessee statutes that define the defenses set forth in the motion. I also included four relevant cases to help support why the motion should be granted in court. These references address each of the three issues stated in the motion to dismiss. View
